Foreign-domiciled insurance companies (i.e. risk-bearing entities) desiring to write insurance in Ohio on a non-admitted excess and surplus lines basis must first obtain written approval from the department as required by subdivision (A) of Section 3905.33 of the Ohio Revised Code. Ohio has no “seasoning requirements.” No fees are due with the application.
Approved non-admitted excess and surplus lines insurance companies are not “authorized” or “licensed” insurance companies and are not approved to write insurance in Ohio other than on an excess and surplus lines basis. Approval for alien insurance companies is accomplished through the National Association of Insurance Commissioners (NAIC) by inclusion in the NAIC publication Quarterly Listing of Alien Insurers.
